terms & conditions consignment

These Consignment Terms & Conditions ("Terms") govern the relationship between Amado, a trading name of Omas Collective Ltd ("Amado", "we", "us" or "our"), and the client ("Client", "you" or "your") who consigns items for sale through Amado.

By consigning items with Amado, you agree to these Terms.

1. eligibility

Amado works exclusively with a select network of trusted UK-based clients.

We reserve the right to accept or decline any item for consignment at our sole discretion.

2. ownership and item condition

By consigning an item, you confirm that:

  • You are the legal owner of the item;

  • You have the right to sell the item;

  • The item is not subject to any finance agreement, security interest, dispute or legal claim;

  • All information provided to Amado regarding the item is accurate and complete;

  • The item is clean, wearable and accurately described;

  • The item is in excellent pre-owned condition unless otherwise agreed by Amado.

Amado reserves the right to decline any item that does not meet our standards for quality, condition or saleability.

Ownership of the item remains with the Client until the item is sold.

3. authenticity

We only sell items that we are fully confident are authentic.

If Amado has any concerns regarding the authenticity of an item, we reserve the right to:

  • Decline the item for sale;

  • Request additional information or proof of purchase;

  • Obtain independent third-party authentication;

  • Return the item to the Client.

Any item subsequently suspected of being counterfeit will be immediately withdrawn from sale and returned to the Client.

Where third-party authentication is required, Amado reserves the right to recover all or part of the authentication costs from the Client, particularly where additional verification becomes necessary due to insufficient supporting documentation or uncertainty surrounding an item's authenticity.

Amado reserves the right to permanently refuse future consignments from any Client found to have submitted counterfeit goods.

4. pricing

Amado will determine the listing price of each item based on market conditions, brand, condition, demand and our experience within the resale market.

Where a Client specifies a preferred sale price before listing, Amado will endeavour to honour that instruction.

Amado reserves the right to reasonably reduce the advertised sale price of any item over time in order to facilitate a sale without seeking further approval from the Client.

5. marketing and promotion

The Client grants Amado a non-exclusive, royalty-free right to photograph, reproduce, publish and otherwise use images, descriptions and details of consigned items for the purposes of marketing, promotion and sale.

This includes, but is not limited to:

  • The Amado website;

  • Social media platforms;

  • Email marketing campaigns;

  • Digital advertising;

  • Printed promotional materials.

No personal information relating to the Client will be disclosed without prior consent unless required by law.

These rights shall continue for as long as reasonably necessary to market and sell the item and, following a sale, to promote Amado's services and previous inventory.

6. commission

Amado shall retain a commission of 35% of the final sale price of each item sold.

The remaining balance shall be payable to the Client in accordance with these Terms.

7. payment to clients

Client payments are made monthly.

Payments will only be made following successful completion of the sale and receipt of cleared funds from the buyer.

Amado reserves the right to withhold payment where a transaction is subject to a dispute, chargeback, suspected fraud or return investigation.

8. item preparation and care

Amado reserves the right to recommend cleaning, repairs or preparation work where this is considered necessary to maximise the saleability of an item.

Where professional cleaning or dry cleaning is recommended, Amado will seek the Client's consent before arranging such services.

Where consent is provided, Amado reserves the right to recover all or part of the associated costs from the Client's sale proceeds.

Amado will take reasonable care of all consigned items while in our possession.

However, except where caused by our negligence, Amado shall not be liable for loss, theft, accidental damage, deterioration or events beyond our reasonable control.

Clients are encouraged to maintain appropriate insurance cover where necessary.

9. unsold and abandoned items

Consigned items will remain available for sale unless otherwise agreed.

Clients may request the return of any unsold item at any time by contacting Amado.

The Client shall be responsible for all return shipping costs.

Amado reserves the right to require reasonable notice before returning consigned items.

Where a Client fails to respond to communications regarding the return of unsold items for a period of six months or more, Amado reserves the right to donate, recycle, dispose of or otherwise deal with such items at its discretion without further liability to the Client.

10. withdrawal of tems

Clients may request the withdrawal of an item from sale at any time prior to a sale being completed.

Where an item has already been sold, reserved, or is subject to an ongoing transaction, withdrawal may not be possible.

The Client shall be responsible for any return shipping costs associated with withdrawn items.

11. buyer returns and disputes

Where a buyer raises a dispute or return request, Amado shall have sole discretion to investigate and determine the appropriate outcome.

Where a refund is issued to a buyer, any associated Client payment relating to that transaction may be withheld, reversed or adjusted accordingly.

12. limitation of liability

To the fullest extent permitted by law, Amado's liability to the Client shall be limited to the net amount ultimately received by Amado from the sale of the relevant item.

Amado shall not be liable for any indirect, consequential or economic loss arising from the consignment or sale of any item.

13. termination

Amado reserves the right to terminate a consignment relationship at any time and for any reason.

Upon termination, any unsold items will be returned to the Client at the Client's expense.

14. changes to these terms

Amado reserves the right to amend these Terms at any time.

Any updated version will apply to future consignments following publication or notification.

15. governing law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
